To participate in our cash payment plan, you must sign a statement regarding the settlement of any claim for damages due to medical malpractice. The agreement specifies that any claims for medical liability will be handled by binding arbitration, not a court, and that the maximum amount awarded for actual economic loss will be limited to $200,000. In addition, the maximum damages awarded for non-economic loss (pain and suffering) will be limited to $100,000. If the arbitrator finds that a filed claim has no merit (and thus should not have been filed in the first place) then the patient is responsible for paying the full cost of arbitration.
